These Terms and Conditions ("Terms") govern your access to and use of the Rising Minds Academy website (therisingmindsacademy.com.au), the R.M.A. Coach subscription video library, and any related services (together, the "Services") provided by Rising Minds Academy Australia ("we", "us", "our"). By accessing the Services, creating an account, or purchasing a subscription, you agree to these Terms. If you do not agree, do not use the Services.

1. Who we are
Rising Minds Academy Australia is a sole-trader business based on the Central Coast, New South Wales. All correspondence should be directed to therisingmindsacademy@gmail.com.
2. Who can use the Services
You must be at least 18 years of age to create an account or purchase a subscription. If you are purchasing a subscription on behalf of a minor (such as a young athlete), you confirm that you are the parent or legal guardian of that minor and accept these Terms on their behalf.
3. Nature of the content
The Services provide general mental performance, mindset, and sports education content. This content is educational and informational only. It is not psychological advice, medical advice, diagnosis, or treatment, and must not be relied upon as a substitute for consultation with a registered psychologist, medical practitioner, or other qualified professional. If you or a young athlete in your care are experiencing mental-health concerns, please contact a qualified health professional, your GP, or in Australia call Lifeline on 13 11 14.
4. Subscription plans and payment
The R.M.A. Coach subscription is billed at the price displayed on the Plans and Pricing page at the time of purchase (currently A$9.99 per month, including GST where applicable). Payment is processed through our third-party payment provider (Wix Payments). Subscriptions automatically renew each month until cancelled by you. You authorise us to charge your nominated payment method for each renewal.
We may change subscription pricing at any time. Any change will apply to your next billing cycle, and we will give you reasonable notice before it takes effect. Continuing to use the Services after a price change constitutes acceptance of the new price.
5. Cancelling your subscription
You can cancel your subscription at any time through your member account area. Cancellation takes effect at the end of your current billing period — you will retain access to the content until that period ends, and you will not be billed again. We do not provide pro-rata refunds for partial months (see the Refund Policy).
6. Your account
You are responsible for keeping your login details secure and for all activity that occurs under your account. Do not share your password, login credentials, or account access with any other person. Each subscription is for a single household only.
If we reasonably believe that an account is being shared outside a single household, used commercially, or used to redistribute our content, we may suspend or terminate the account without refund.
7. Licence and permitted use
Subject to these Terms and payment of all applicable fees, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to access and view the Services for your own personal, non-commercial use and the use of the minor in your care.
You must not:

copy, download, screen-record, redistribute, publish, or publicly display any of our videos or written content;
share, sell, sublicense, or rent your account access;
use any part of the Services to train machine-learning or AI models;
use the Services to provide paid coaching, counselling, or educational services to third parties;
reverse-engineer, scrape, or attempt to circumvent any technical protection measure; or
use the Services in any way that is unlawful, defamatory, harassing, or harmful to any person.

8. Intellectual property
All videos, written materials, graphics, logos, branding, and other content made available through the Services are owned by Rising Minds Academy Australia or its licensors and are protected by Australian and international copyright law. Nothing in these Terms transfers any ownership rights to you.
9. Content availability
The content library evolves over time. We may add, remove, change, or re-sequence videos and other materials without prior notice. We do not guarantee that any particular video will remain available for any particular period.
10. Your Australian Consumer Law rights
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law, including that services will be rendered with due care and skill and be fit for any specified purpose. If we fail to meet a consumer guarantee, you may be entitled to a remedy.
11. Limitation of liability
To the fullest extent permitted by law, and except in relation to non-excludable consumer guarantees:

we provide the Services on an "as is" and "as available" basis and make no warranties about uptime, accuracy, or outcomes;
we are not liable for any indirect, consequential, incidental, special, or punitive loss, including loss of profits, loss of data, or loss of opportunity; and
our total aggregate liability to you for any claim arising out of or in connection with the Services is limited to the total fees you paid us in the three (3) months immediately before the event giving rise to the claim, or (at our option) the resupply of the Services.

12. Indemnity
You agree to indemnify us against all claims, losses, damages, and costs (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services, or your infringement of any third-party rights.
13. Suspension and termination
We may suspend or terminate your access to the Services at any time if you breach these Terms, if required by law, or if we reasonably believe your conduct poses a risk to us, other users, or third parties. If we terminate for breach, no refund is payable.
14. Privacy
Our handling of your personal information is governed by our Privacy Policy, available on the website. By using the Services you consent to the collection and handling of your personal information as described in that policy.
15. Changes to these Terms
We may update these Terms from time to time. The updated version will be published on the website with a revised "Last updated" date. Material changes will be communicated via email or a notice on the website. Continued use of the Services after a change constitutes acceptance of the updated Terms.
16. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.
